14 A sample provision reads: “In addition to all other powers conferred by law or other provisions in this will, my Executor shall have the following powers which may be exercised without order or license of any court: … F. Impose easements or other restrictions (including without limitation any ‘qualified conservation easement,’ within the meaning of Section 2031(c) of the Internal Revenue Code of 1986, as amended, or corresponding provisions of future federal tax laws); and to donate the real estate or interests therein to charitable or public uses;…” This provision is used by Kevin Meuse of Kirkpatrick and Lockhart, L.L.P., Boston, Massachusetts.
15 As of late 2000, land trusts that have accepted a post-mortem donation include the Montana Land Reliance, the Society for the Protection of New Hampshire Forests, and the Jackson Hole Land Trust (Wyoming).
